Marketing compliance in consumer finance was built around one checkpoint: the review before a piece of marketing goes live. That model is under strain. Marketing now ships faster and across more channels than any team can clear in advance, including owned pages, affiliate and partner placements, and copy that an AI tool drafted. Once content is live, it keeps moving. Rate and fee claims go stale, disclosures drop off, partners reuse and adapt messaging, and old pages resurface in search. Increasingly, customers hear about products from an AI assistant rather than from the brand itself, in words no one at the firm wrote or approved. The bank or issuer stays responsible for all of it, including marketing published by partners it does not directly control and copy written by a tool rather than a person. Meanwhile the regulatory picture is moving in two directions at once, easing in some places while liability and state-level attention pick up in others.
